  5. DYNAMIC GIN IS PROVIDED BY CYBERSYM TECHNOLOGIES STRICTLY ON AN "AS IS" 
  6. BASIS. CYBERSYM TECHNOLOGIES MAKES NO EXPRESSED OR IMPLIED WARRANTIES 
  7. ABOUT THE SUITABILITY OR RELIABILITY OF DYNAMIC GIN FOR ANY PURPOSE. 
  8. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, CYBERSYM TECHNOLOGIES 
  9. DISCLAIMS ANY AND ALL LIABILITY FOR ANY DIRECT, INDIRECT, SPECIAL, 
  10. INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR OPERATION 
  11. OF DYNAMIC GIN, OR FROM INABILITY TO USE DYNAMIC GIN. THE USER ASSUMES 
  12. THE ENTIRE RISK OF EVALUATING AND USING THE PROGRAM. THE SOLE LIABILITY 
  13. OF THE SELLER WILL BE LIMITED TO REPLACEMENT OF THE PRODUCT OR REFUND 
  14. OF THE PURCHASE PRICE.

  16. Software License Terms
  17.  
  18. COPYRIGHT.  The Dynamic Gin software (including any and all images and 
  19. text incorporated into Dynamic Gin) is owned by CyberSym Technologies 
  20. and protected by United States copyright law and international treaties.  
  21. You may not make or use copies of Dynamic Gin except as expressly 
  22. permitted under the Distribution and License provisions of this 
  23. agreement. All other rights not expressly granted here are reserved by
  24. CyberSym Technologies and its assigns or successors.  
  25.  
  26. DISTRIBUTION.  You are free to distribute Dynamic Gin as shareware 
  27. to others, provided you distribute all original files without 
  28. modification, and provided you accept no compensation. No one may 
  29. distribute any Dynamic Gin user authorization code to any other 
  30. individual or group, with the sole exception that a valid owner of a 
  31. registered license for Dynamic Gin may transfer that license and its 
  32. user authorization code to another individual. When such a transfer is 
  33. made, the original owner must transfer or destroy any copies of Dynamic 
  34. Gin that use that authorization code.

  36. In addition, the accompanying VENDINFO data file (VENDINFO.DIZ in the 
  37. installation package or DYNGIN.DIZ or DYNGIN32.DIZ in the directory 
  38. where Dynamic Gin is installed) is hereby incorporated by reference. 
  39. Any distribution satisfying all the distribution requirements expressed 
  40. in that data record is hereby authorized.

  42. SHAREWARE EVALUATION LICENSE.  Dynamic Gin is shareware. Before 
  43. purchasing Dynamic Gin, you are entitled to use and evaluate one (1) 
  44. copy of Dynamic Gin for free during one (1) evaluation period of 36 days 
  45. or 30 sessions, whichever is longer. (A session cannot exceed 24 
  46. hours.) Use of Dynamic Gin beyond this evaluation period constitutes 
  47. copyright infringement unless you have obtained a valid registered 
  48. license for Dynamic Gin.

  50. REGISTERED LICENSE.  Upon purchase of Dynamic Gin, you receive a 
  51. registered license and a unique user authorization code. The registered 
  52. license gives you nonexclusive permission to make and load as many 
  53. copies of major version 1 of Dynamic Gin (16-bit and/or 32-bit editions) 
  54. or any of its minor version revisions on as many computers as you own, 
  55. provided that no more than one of those copies of Dynamic Gin is ever in
  56. use at any one time.

  58. APPLICABILITY AND SEVERABILITY.  This Agreement shall be governed by 
  59. the laws of the State of Utah. If any provision of this Agreement shall 
  60. be held to be invalid or unenforceable for any reason, the remaining 
  61. provisions shall continue to be valid and enforceable. If a court finds 
  62. that any provision of this Agreement is invalid or unenforceable, but 
  63. that by limiting such provision it would become valid or enforceable, 
  64. then such provision shall be deemed to be written, construed, and 
  65. enforced as so limited.
